Yesterday, the European Commission hosted the Our Baltic Ministerial Conference in Stockholm to discuss the future of the Baltic Sea, with the participation of ministers from the Baltic region and the EU Commissioner for Fisheries and Oceans, Costas Kadis. This event marked the first initiative under the Ocean Pact on fisheries matters. In this context, Europêche urges the European Commission, Member States and the European Parliament to swiftly agree on a binding recovery plan for the Baltic Sea.

“There is no need for more conferences or promises. What we urgently need is a binding action plan to address the multiple factors that have shocked the marine environment in the Baltic Sea,” stressed Kenn Skau Fischer, CEO of the Danish Fishers PO.

Regime shift in the Baltic Sea

Europêche stresses that no Member State can address the Baltic crisis alone; a coordinated, cross-border approach is essential. The Baltic Sea is facing unprecedented pressures from nutrient emissions, chemical pollution, expanding offshore energy, climate change, and the uncontrolled growth of predator populations such as seals and cormorants. These factors are driving a fundamental ecosystem regime shift and continue to impede the recovery of fish stocks, despite strict fishing restrictions already in place.

“One country cannot shoulder this challenge on its own. All parties must pull together. We call on ministers to stand ready, work constructively with the Commission and find workable solutions for the future of the Baltic and our fishers,” said Kenn Skau Fischer.

Solution beyond fisheries management

The fishing sector has made an unprecedented reduction in catches designed to minimise pressure on fish stocks and allow fish populations to thrive. Yet, recovery remains blocked by environmental pressures beyond fisheries. Europêche insists the Common Fisheries Policy (CFP) must be revised to allow measures tackling broader ecological threats. “One thing is clear: if nothing is done to address the above-described stressors, fish stocks will not recover, regardless of catch limits,” warned Kenn Skau Fischer.

In this regard, challenges such as climate change require long-term solutions, while eutrophication and pollution demand medium-term action. Others, like excessive predation from seals and cormorants, can be addressed more immediately.

Inclusive dialogue with fishers

Despite the importance of today’s conference, discussions remained largely at the institutional level. “It is regrettable that those who know the Baltic best – the fishers – were not given broader representation at the discussion panels to contribute their views. Without their presence and involvement, there is a real risk this becomes yet another academic exercise,” stated Daniel Voces, Managing Director of Europêche.

Europêche will continue to engage constructively and will meet Commissioner Kadis on 3 October to exchange views on the Baltic’s future.

As part of its Biodiversity strategy, the European Commission proposed last year its flagship Nature Restoration Law which calls for new binding targets to restore degraded ecosystems. The Regulation is bound to have huge and devastating consequences for farming and forestry across the EU, to close countless fishing grounds for restoration purposes.

The Commission conducted an impact assessment which does not accurately represent the actual impact on the primary producers in Europe, and instead focused on the benefits it will have for society. The Commission expects all restoration to come from the CAP or EMFAF, when these budgets are already over-stretched; and refuses to propose a concrete Restoration Fund for the benefit of all actors in this transition. As a result, in an unprecedented move, the European Parliament’s Committees on Agriculture (AGRI) and Fisheries (PECH) have rejected the proposal. On 15 June, the European Parliament’s Committee on Environment (ENVI) will take a final decision on the file. Copa-Cogeca and Europêche call on this Committee to hear and respect the concerns of the farmer and fisher communities and request the Commission to restart the process from the scratch.

The European Commission proposed last year a Nature Restoration Law, introducing new legally binding targets and obligations for Member States, and indirectly on our European primary production sectors. All Members of the European Parliament who supported rejection said yes to nature restoration but no to an ill-thought out, unrealistic, and unimplementable legislation that endangers farmers and fishers’ livelihoods and food production in the EU. These sectors have been facing not only global challenges (e.g., Covid, energy crisis, war), but also radical environmental EU policies that are deeply affecting EU food production and food sovereignty.

Niels Peter Nørring, Chairman of the Working Party on Environment for Copa-Cogeca, declared: “A good Nature Restoration Law cannot be designed without the clear commitment of farmers and fishermen. So, instead of threats and backdoor deals, the European Commission should go back to the drawing board. EU authorities must respect and acknowledge that those who will be implementing this law do not see it as feasible, workable, nor implementable.”

Javier Garat, President of Europêche, commented: “The Commission has created a polarised debate around the EU Nature Restoration Law. Likewise, NGOs have politicized and simplified the debate by listing MEPs in favour or against nature. But the problem is that we have reached a point where protection is synonymous with exclusion. We must try to make environmental protection compatible with human activity and in particular with the much-needed production of food. We are already importing 70% of the seafood we are consuming in Europe. The new Law will certainly contribute to increase the food security gap.”

According to the sector, the troubled debate about the new environmental law made one thing clear. In order to meet the needs of its people, the EU must give a straight answer to fundamental question: How much food should the EU produce/import and is it wise to entrust our food security to third countries?

Copa and Cogeca are the united voice of farmers and agri-cooperatives in the EU. Together, we ensure that EU agriculture is sustainable, innovative and competitive, while guaranteeing food security for 500 million people throughout Europe.
During the plenary session of the European social dialogue committee for sea fisheries held last week, ETF and Europêche adopted a joint resolution establishing benchmark principles aimed at better regulating the proliferation of sustainability labels certifying social conditions on board fishing vessels. The intention is to avoid social-washing labels while stressing the importance of the ILO “Work in Fishing” Convention C188 as guardian of human and labour rights of fishers at sea, which cannot be replaced or substituted by private schemes.

Voluntary social standards and certifications were recognised as drivers of sustainable economic development and a vital instruments to support learning, dialogue and trust-building between companies and stakeholders. However, Social Partners agreed on the fundamental principle that private labels can never go below the internationally recognised social standards set in ILO Convention C188.

“ILO C188 contains the minimum compulsory requirements to be respected and should be included in full, avoiding any cherry-picking in any voluntary certification scheme. The private labels which do not cover those minimum standards, should not be recognised as socially sustainable. So, any social-washing labels from 3rd countries shall be left out of the single market”, said Juan Manuel Trujillo, ETF Fisheries Section Chair.

Europêche’s spokesperson in the European social dialogue, Ment van der Zwan, added: “In a highly competitive market for sustainable seafood products, admitting sub-standard certification schemes as socially sustainable would expose EU fishermen and companies to unfair competition. EU consumers would as well be highly misguided by the information provided by the label. Customers may chose a product labelled as socially sustainable, that in reality is not, over an European product with no such label but that by definition has to comply with higher social standards. It would be illogical and a commercial ruse.”

Today, after long hours of discussion in Luxembourg, EU Fisheries Ministers reached an agreement on the catch limits for 2022 for the ten main commercial stocks in the Baltic Sea. Despite the huge quota cuts in the last years for key species such as cod and herring in certain areas, the poor environmental status of the Baltic Sea, and not overfishing, is affecting the sustainability of these stocks. Nevertheless, Ministers have decided to further reduce fishing opportunities for Western and Central herring as well as for Western cod. On the positive side, the Council has agreed to increase fishing opportunities for plaice, sprat, Bothnian herring and Gulf of Finland salmon. Despite these increases, the reality is that 2022 will still remain an extremely challenging year for the Baltic fishers.

The Council of Ministers agreed to cut by half the Total Allowable Catches (TAC) for herring in the Western part of the Baltic Sea and can only be caught now as by-catch. In the Central Baltic, the TAC was cut by 45%. Given the lack of progress in cod stocks, the Council has maintained a TAC only for by-catches, slashing by 88% the quota for Western cod. The catch limits for Salmon in the Main Basin have been reduced by 32%, although the TAC for salmon stocks in the Gulf of Finland saw a slight increase.

Despite the scientific advice recommending a quota increase for plaice and sprat, the European Commission proposed to maintain the TAC level unchanged. Ministers deviated from this approach and decided to increase the quota by 25% and 13% respectively. Peter Breckling, Deutscher Fischerei Verband (DFV), declared: “We welcome this Council’s decision which balances the socio-economic needs of our fishermen with the long-term sustainability of these fish stocks. More selective trawl gears are available which can certainly mitigate the impact on other species such as cod or herring. Plaice and sprat are now vital for the survivability of our fishing companies”.

Europêche stresses that due to the significant reduction of the main target species Western cod and Western herring quota for several years, fishing companies and local associations face a very critical situation. Mr Breckling declared: “Without enough fish, the infrastructure of commercial fisheries cannot keep working on a viable economic level. Two local cooperatives in Germany already closed down. It is likely that others will follow and severe structural changes may occur. This should also be subject to responsible management”.

Europêche regrets, however, the misinformation campaigns on the state of the cod stock, claiming that this iconic species could be in danger of biological extinction in the Baltic Sea. What happens in reality is that in order to reach Maximum Sustainable Yield (MSY) levels, a targeted fishery is not possible, as in this case, to get the fish stock to healthy levels. Europêche argues that this has nothing to do with biological extinction. Moreover, before a marine fish stock can be biologically extinct, the fishing companies would go bankrupt.

Mr Breckling concluded: “After a significant fleet capacity reduction in all Baltic states and a fishery in line with scientific advice, it is really strange to blame ‘overfishing’ as the main driver for the present situation. At present, natural cod mortality is 3 to 4 times higher than fisheries mortality, meaning that the cod stock deterioration is largely driven by poor oxygen conditions, migration of its fish prey and high levels of parasite infestations caused by uncontrolled growing populations of seals. This also explains why despite the closure of Eastern Baltic cod in 2019 the stock did not react up till now.
European Transport Workers’ Federation (ETF) and Europêche have published new Guidelines on the medical examinations of fishers, paving the way for the harmonisation of standards for health and fitness checks across Europe and worldwide.

Sea fishing is a remote profession and therefore deprived from immediate medical assistance at a level shore-based people can rely on. In relation with the relevant safety challenges performing their work at sea, it’s important that fishers on board fishing vessels are qualified and fit for their duties. This reality is well recognised by international and European legislation[1] which require fishers to hold a valid medical certificate issued in accordance with their provisions.

In practice, however, despite the obligation for fishers to hold a medical certificate, there are no specific international guidelines for the medical examination of fishers, in stark contrast with merchant seafarers.

“In the making of international medical guidelines for the examination of seafarers, fishers were shockingly excluded. While certain countries apply guidelines for seafarers to fishers, those guidelines haven’t been designed with that goal in mind, and they don’t completely fit specificities of sea fishing”, said Ment van der Zwan, Europêche Spokesperson in European social dialogue.

European social partners, the ETF and Europêche, have been working together with the International Maritime Health Association (IMHA) on closing this gap in international occupational health and have now published guidelines for fishers and their specific working environment.

“In such a physically-demanding job, the existence of specific guidelines for medical examination of workers is a must. We hope that these new guidelines will be used as a tool by doctors performing medical examinations to have a clear understanding of the unique aspects of fishing, as their professional judgement is critical to the health and safety of fishers. Competent authorities should also harmonise the criteria used for the medical checks of fishers and thereafter mutually recognise certificates of medical fitness. The increasing internationalisation of fishing makes such harmonisation even more important.” underlined Juan Manuel Trujillo, ETF Fisheries Section Chair.

The ETF and Europêche will continue to promote the harmonisation of standards for the medical examinations of fishers at European and International level. Using harmonised approaches and carrying out systematic monitoring programs will be vital in improving fishers’ health and safety.

European social partners in the fisheries sector, ETF and Europêche, call on the European Commission to support Member States in developing a specific COVID-19 vaccination protocol for fishers, adapting and prioritizing their access to the vaccine. Considering their recognition as essential workers and the particularities of the fishers’ workplaces and working patterns, the social partners have put forward practical guidelines that can help accelerate the process.

Fishers are a cornerstone of seafood supply and food security in Europe. Still, they haven’t been prioritised in vaccination programs, exposing them to growing infection rates on fishing vessels and preventing the necessary crew changes around the world.

Unlike many other workers, fishers are limited in what they can do to avoid infection in their workplaces. The work of fishing crews takes place in confined spaces, where it is impossible to maintain physical distance and with the high risk of coronavirus transmissibility. Additionally, the often long periods of stay on board ships make it challenging to immunise them on the pre-established schedule for the general population. Europêche and ETF believe that this unique situation requires a special approach to vaccinations and call on Member States to develop new protocols at once.

“The fisheries sector has been recognised as an essential and strategic sector during the pandemic for its vital work in the supply of seafood and food security,” says Ment van der Zwan, Europêche Spokesperson in the European social dialogue. “To protect the supply, we need to protect the workers that support it and guarantee their speedy access to vaccines“.

The social partners have outlined a list of guidelines that can help states establish vaccination protocols for fishers in a way that responds to their specific working environments. They call for prioritisation of fishers in vaccination, coordination of vaccinations through national authorities, and, where possible, provision of single-dose vaccines for workers who remain on board for long periods. They also emphasise the need to establish a right to receive vaccination not only in the flag state but also in their country of residence and in port states.

“This vaccination must be available for all crews operating under European flagged vessels, whatever their nationality,” added Juan Manuel Trujillo Castillo, ETF Fisheries Section Chair. “This is common sense, particularly for the numerous fishing crews working on vessels that operate for weeks without returning to port.”

The social partners’ appeal aligns with the recent call of five UN agencies, encouraging governments to “give priority to fishers, seafarers and aircraft crews in their national vaccination programs.”

ETF and Europêche call on the European Commission to urge EU Member States to support the key workers of the fishing industry during the coronavirus crisis and prioritise their access to the vaccine to keep essential fishing operations running.

This morning, the European Parliament adopted its position on a new set of rules meant to revise the Union Fisheries Control System. In general terms, the Parliament position improves the proposal from the European Commission modernising control and enforcement measures without penalising or creating excessive bureaucracy to fishers. Particularly positive were the changes introducing more flexibility on the margin of tolerance for weight estimates done by fishers on board and the exemption of engine power monitoring devices for fisheries subject to catch limits. However, there is a huge elephant in the room, the mandatory installation of cameras to control a failed EU policy, the landing obligation. In this context, Europêche hopes that governments address this “big brother” issue within the Council in the following months.

The Plenary vote respected the majority of the compromises found within the European Parliament committee on Fisheries. These agreements will help enhance the traceability of seafood products, digitise tracking and catch reporting across the value chain and harmonise sanctions and enforcement measures across Member States. Europêche welcomes the flexibility provided in terms of timing, scale and bureaucracy thus showing closer ties with the fisheries reality.

Europêche appreciates the flexibility on the estimates recorded in the fishing logbook for each species which are extremely difficult to match with the quantities actually landed. The sector appreciates the introduction of higher margins of tolerance for mixed, small pelagic, tuna and industrial fisheries. According to Daniel Voces, managing director of Europêche: “Many have accused fishers of using this measure to under declare fish. These voices neglect the current hefty fines faced by fishers, forget that the quantities reported in the logbook are just estimates and ignore that these estimates could be lower or higher than the actual landings without any malicious intention from the fisher. With or without a margin of tolerance, compliance with a faithful declaration on the fish caught is ensured when contrasted with the weighing on landing and the sales notes.”

Contradicting the position previously adopted in the fisheries committee, the European Parliament adopted by a very slight majority (8 votes difference) the introduction of cameras on board fishing vessels. These will be mandatory for vessels over 12 metres identified as posing a high risk of non-compliance with the landing obligation.

Mr Voces, declared: “Will EU policy-makers agree to install CCTV systems in their own offices to ensure that tax-payers money is well managed, spent and maximized and to guarantee that nobody breaches the Law in their daily activities? We believe the answer is no. Why then fishers, who actually hold an excellent record of compliance? We cannot feel but persecuted and criminalised by an EU that constantly applies a presumption of guilt based on mistrust towards the sector.”

The EU fishing industry is confronted with an ill-conceived policy, the landing obligation, not fit for the EU fisheries reality which EU decision-makers are trying to enforce through intrusive control and monitoring tools. Important fishing nations such as Norway and Iceland, with landing obligation policies in place, are against the use of cameras and yet can perfectly control their fleets’ operations. According to Europêche, this refutes the Commission’s claim that infringements will never be detected without CCTV.

Negotiations with Member states will now follow in the coming months, after which a final decision will be taken.

At the Plenary meeting held yesterday, the EU Social Partners in the Fisheries Sector – Europêche, Cogeca and ETF – welcomed the presentation of the Parliamentary draft report “Fishers for the future: Attracting a new generation of labour to the fishing industry and generating employment in coastal communities” of the Member of the European Parliament, Manuel Pizarro. While acknowledging the report as an important step in the right direction, social partners call on the policy-makers to recognize the key social dimension of fishing, thus improving the health and safety of fishers and attracting youth to the sector.

The report addresses important difficulties faced by the EU fishing industry owing to the ageing of the workforce, high rate of accidents at sea, absence of harmonized training standards, poor image of the sector, lack of recognition of fishers’ qualifications at EU level, low women’s employment rate and lack of attractiveness of the sector for young fishers.

Social partners believe that the Common Fisheries Policy (CFP) must ensure that fishing activities are environmentally sustainable in the long-term while achieving economic, social and employment benefits and contributing to the availability of food supplies. Unfortunately, trying to achieve this already complex balance often leaves out the protection and wellbeing of fishers. The Social Partners regret that the fishing industry performance is repeatedly assessed in terms of ‘money’ and ‘planet’, but neglecting the ‘people’ who bring seafood to our tables.

Mr Pizarro and the Social Partners agree that prosperous and sustainable fishing requires specific attention and regulation to address issues not sufficiently covered by current fisheries policies, such as the social dimension of fishing. They pledge to work together to close existing legislative and policy gaps that, for far too long, have existed in the CFP.

Ment van der Zwan, Europêche’s spokesman on social affairs, declared: “The report is an important step in the right direction. However, we feel that more attention is needed towards the ratification and implementation of internationally agreed social and safety standards that protect fishers in all aspects of their work. For that reason, we call on all Member States to ratify the pioneering Work in Fishing Convention No 188. We also request the European Commission to propose a Directive to establish a harmonised inspections system on control and enforcement of social provisions. It is equally important that the Commission proposes a Directive to ensure harmonised training and safety standards in the EU by transposing the IMO STCW-F Convention”.

Juan Manuel Trujillo, workers’ spokesman in the EU social dialogue committee on sea-fisheries, stated: “We endorse the objectives set in the report. Additionally, it should underline the clear contradiction between the CFP and the requirements set out in social legislation such as the ILO C188. While the latter requires more space on board for the benefit of the crew, the CFP prevents the increase of space on board, even when the goal is to improve working and living conditions. We, therefore, urge the European Commission to identify alternative formulas for measuring fishing capacity that exclude areas for leisure and comfort from the calculation. Recreational space on board has nothing to do with the ability of the vessel to find, catch or store fish. Furthermore, the current capacity measurement rules jeopardise women’s access to the sector since separate cabins, toilets and showers are needed to guarantee their privacy and wellbeing. In particular in certain regions, such as the Mediterranean, the decreasing profitability of the sector due to the continuous reduction of fishing opportunities is a major obstacle for young workers to get in the fishing sector”.

Mr Pizarro concluded: “We need adequate social policies to guarantee better working and living conditions on board fishing vessels not only to attract young people to the activity but also to improve the safety and wellbeing of fishers. Despite technological improvements already introduced, still many accidents occur at sea, many of them related to human errors”. He continued: “It is equally important to debunk the myths and misconceptions surrounding the sector. Fishers should be seen as guardians of the sea and its resources. Only a positive perception of the profession that can offer a bright future to young people can secure the generational change of fishers”.
