Europêche, the leading representative body for the fishing sector in Europe, stresses the need to fully integrate fisheries into EU trade policy to safeguard fair competition, sustainable seafood and the long-term viability of the EU fleet.

Yesterday, Europêche held a constructive meeting with Mrs María Martin-Prat, Deputy Director-General at the European Commission’s Directorate-General for Trade, and her team covering Asia and trade policy coordination. The dialogue focused on securing fair market conditions for EU seafood producers in ongoing trade negotiations — particularly with Thailand and North Atlantic partners — and ensuring that fisheries’ competitiveness, sustainability and social standards are not undermined by trade liberalisation.

Javier Garat, President of Europêche, stated: “We strongly support open and rules-based trade, but not at the expense of the future of our fishers. The EU cannot continue to tighten sustainability obligations on its own fleets while granting duty-free access to products caught or processed under far lower environmental and social conditions. Stronger coordination between DG TRADE and DG MARE is essential to ensure that trade policy upholds the same sustainability and social standards that guide the EU’s fisheries policy and guarantees a true level playing field.”

EU- Thailand Free Trade Agreement between: Prevent unfair competition from low-standard tuna

Thailand is one of the world’s largest tuna processors, producing around 450,000 tonnes annually yet exporting only about 10,000 tonnes to the EU due to existing tariffs. Europêche warned that eliminating or relaxing these tariffs under a future FTA would seriously distort competition, as tuna processed in Thailand often originates from fleets with weak labour and environmental standards, raising risks of IUU fishing and forced labour, but also production costs. It is twice more costly to catch one ton of tuna on a European vessel than on South-East Asian ones.

Europêche calls for applying extremely strict rules of origin, applying only to wholly obtained tuna and excluding cumulative rules, imposing binding ratification of ILO Fundamental Conventions 87 as a precondition for tariff benefits. Equally important is applying enhanced traceability and origin labelling to ensure EU consumers know the true source of imported tuna: the flag of the vessel and catch area.

Trade and Cooperation Agreement with United Kingdom: Ensure post-Brexit mutual access and fairness in marine environmental policies

Europêche welcomed the extension of reciprocal fishing access until 2038 under the EU–UK agreement but expressed concern over new Marine Protected Area restrictions. First implemented in Scottish waters and now projected in Southern UK waters, the impact of these measures falls disproportionately on European vessels, which suffer nearly five times greater economic losses compared to UK vessels operating in the same areas. The organisation urged the Commission to ensure that MPA measures remain proportionate, non-discriminatory and compliant with the Trade and Cooperation Agreement (TCA), and to press the UK to reopen the sandeel fishery unjustifiably closed to EU vessels. DG TRADE showed interest in the concerns raised by Europêche and encouraged continued dialogue with DG MARE. The Directorate also expressed interest in receiving additional technical information to further inform its assessment of the issues.

Norway and Coastal States: Protect the EU market from catches originated from unilateral overfishing of shared stocks

Europêche denounced the unilateral quota increases by Norway, the Faroe Islands and Russia on key pelagic stocks, especially mackerel, herring and blue whiting, which have caused overfishing and a 70% drop in mackerel catches for next year. The organisation called on the Commission to trigger the EU’s new Regulation on unsustainable practices against these actions and to also tackle the import of Russian-caught cod transiting through Norway that arrive to our market tariff free.

Furthermore, Europêche believes that time has come to look into the possibility of amending the fisheries cooperation agreement with Norway in a way that ensures EU-fishers access to Norwegian waters even if quotas are not in place by the first of January. This approach should be considered within a broader context of EU-Norway trade and cooperation.

New EU-Morocco trade and fisheries agreement: Preserving a strategic partnership and sustainable fisheries

Europêche welcomes the new EU mandate to negotiate a fisheries agreement with Morocco, a strategic partner for sustainable, science-based fisheries management and food security. For Europêche it is fundamental that future fishing opportunities reflect the good performance and sustainability of stocks in recent years, particularly the pelagic fishery. The sector urges the Commission to base future arrangements on scientific evidence and mutual economic benefit.

United States: Ensure reciprocal market access

The 15% tariff on EU seafood has created a new trade barrier, causing significant economic harm to European companies, while US exporters continue to enjoy duty-free access for a wide range of seafood products. Europêche called on the Commission to secure equivalent tariff exemptions for key European exports such as bluefin tuna, scallops, and hake, ensuring a level playing field and fair competition across the Atlantic. DG TRADE acknowledged that the 15% tariff represents a negotiated compromise, yet expressed openness to hold a technical meeting.

Autonomous Tariff Quotas: Prevent unfair competition

While access to non-EU raw materials is essential where there is no or insufficient EU production, tariff derogations such as Autonomous Tariff Quotas (ATQs) must be strictly linked to sustainability criteria and excluded for tuna, in order to safeguard fair competition and the long-term competitiveness of EU fleets.

Due Diligence: Equal rules for EU and non-EU operators

Europêche expressed concern that reporting obligations for non-EU operators have been postponed indefinitely, while EU fleets and processors will face these requirements from 2027. This asymmetry would undermine the level playing field and distort competition. Europêche urged the Commission to ensure that due diligence rules apply simultaneously and equally to all companies placing seafood on the EU market, regardless of origin.

WTO Fisheries Subsidies Agreement

Europêche stresses that the next phase must allow essential fleet renewal, safeguard the EU’s sustainable funding model and Sustainable Fisheries Partnership Agreements, and enable vital support measures during crises such as COVID or Ukraine.

Today, the European Commission has published its Communication in response to the citizens’ initiative entitled ‘Stop Finning — Stop the trade’. The campaign aims to end international trade of loose shark. In response to the campaign, the Commission will launch an impact assessment by the end of the year to measure the effectiveness and contribution of EU rules against finning. The Commission will aim to better enforce the EU’s already strong traceability measures and to improve data relating to imports and exports of shark products. Finally, the Commission will aim at enhancing the role of the EU in the global fight against shark finning. Europêche believes that the current framework in Europe guarantees that all shark catches are legal and sustainable. Even if the policy is functioning well, there is always room for improvement and for that reason the sector welcomes the decision to assess the situation in depth before taking any legislative measure.

The European fishing sector, represented by Europêche, unanimously condemns the practice of “finning” (cutting shark fins and throw mutilated bodies into the sea) by any fleet in the world. The EU fleet has never practiced finning, as evidenced by the fact that no EU fishing vessel has been sanctioned for this practice. Javier Garat, President of Europêche, declared, “In the European market, our consumers value, trade and eat the sharks’ meat. In fact, most of the revenue for the fleet comes from the selling of the meat and not the fins. Nothing is wasted”.

According to Europêche, to guarantee the sustainable management of sharks, their fisheries are meticulously regulated by the EU and by UN bodies across all oceans. In international waters, blue shark caches represent more than 95% of the total shark landings. The latest scientific information shows that the population of this species is abundant and healthy in all oceans. Their fins are easily distinguishable, even separated from the body, due to its characteristic metallic blue coloration, the lack of spines at the base, and other factors. Therefore, fishery inspectors, and also traders, can easily make a visual identification.

As regards finning control, since 2013, the EU requires all sharks to be brought to port with their fins naturally attached. This rule must be respected by all EU fishing vessels operating across the world. According to the NGO community, the EU closed back then any loopholes in the EU system. In addition, once landed, the IUU policy requires national authorities to issue a catch certificate that accompanies the body of the shark and the fins up until the point that they reach the consumer. Furthermore, the widely ratified FAO Agreement on Port State Measures requires the verification and inspection of fishing vessels entering ports to ensure that they comply with the Law.

On top of this, last year, the international community agreed to include nearly 100 species of sharks and rays under Appendix II of the Convention on International trade in Endangered Species of Wild fauna and flora (CITES). This will require an export permit, which will only be granted if the national authority verifies that: (i) the export is not detrimental to the survival of the species; and (ii) the specimens were not obtained in contravention of the national laws.

Mr Garat concluded: “Our fishers have changed the way they operate to ensure the full traceability of shark fins. This has not been easy, and rather costly. We are certain that the new trade rules recently adopted by the international community will require further bureaucratic and economic efforts from the administrations and the sector. The Commission is therefore right in carrying out a fitness and data check before proposing new measures. Banning a perfectly legal and sustainable economic activity in Europe, would only cause financial losses to our companies and would deteriorate the situation in Asian markets.”

Since 2019, the sector has been developing a fisheries improvement programme with a focus on swordfish and blue shark. This shows a clear commitment from the sector to improve science, mitigation techniques and increase fisheries observers on board with ultimate goal to obtain a MSC certification.

The new joint project of the European social partners for sea fisheries (Europêche and ETF) has kicked off today in Amsterdam. Following a selection process, Europêche and ETF will count with the participation of specialists to develop a wide range of studies for a safer, healthier and more worker-friendly fisheries sector in Europe and worldwide. The action will focus on trade measures to combat forced labour, develop guidelines on recruitment of migrant fishers, develop a training programme for medical examination of fishers and update a mobile app to facilitate communication on fishing vessels (FisherySpeak).

Safety and health at sea have always been a top priority for both partner organisations involved in the EU project. This action seeks to propose concrete improvements to the EU fisheries policies that could offer better health, working conditions and safety at sea for fishers. In addition, the project aims at enhancing socially responsible fish sourcing and consumption in the EU market.

The activities of the project will run for the next two years. The Social Partners will meet during the European Maritime days of 2023 (Brest, France) and of 2024 (Svendborg, Denmark) to assess, measure and make progress. The final results will be presented in Brussels in the second half of 2024.

About the EU project

The project, co-funded by the EU, partially implements the work programme of the Sectoral Social Dialogue Committee for Sea Fishing in order to significantly make progress in various key areas of interest for Social Partners.

Pillar 1: Guidelines for vessel owners on decent recruitment of migrant fishers. The guidelines will be based on EU legislation and other binding international instruments and be used to constitute model contracts between a fisher and a private employment agency, between a fishing vessel owner and a private employment agency, and fisher’s work agreement.

To be developed by international expert on social affairs, Estelle Brendtall.

Pillar 2: Training programme for doctors performing medical examination of fishers. In the previous project, the Social Partners successfully developed guidelines on the medical examination of fishers. As a continuation of this work, it is essential for doctors, who conduct medical examinations and issue medical certificates, to receive training via guidance which fit the specificities of sea fishers.

To be developed by International Maritime Health Association (IMHA).

Pillar 3: Legal analysis on market and custom tools to combat forced labour in the fishing industry. This pillar will explore the possibility for EU to restrict or prohibit seafood imports from fishing vessels or countries identified for child or serious labour abuse including no respect of basic human rights on board fishing vessels.

To be developed by Marinnleg foundation.

Pillar 4: Upgrade of the ‘’Fishery Speak’ app, an interactive glossary, providing an overview of the main phrases used on board a fishing vessel. The aim of this upgrade is therefore to add further languages identified as essential and the necessary uploads and technical updates of the mobile application.

To be developed by IT company, Innatial developers SL.

Europêche, the leading trade body representing the fishing industry in Europe, strengthens its team to boost the organisation’s support for sustainable tuna fishing and to promote the voice of the sector in wider EU and international decision making. Newly founded Europêche’s tuna group will advocate the interests of the EU and associated tuna freezer purse-seine fleet to enhance business competitiveness, improve the image of the sector, contribute to sustainable ocean governance, support the fight against IUU and labour abuse, and achieve an international level playing field.

The Europêche Tuna Group is comprised of the main two tuna freezer purse-seine organisations in Europe, namely OPAGAC-AGAC and ORTHONGEL. Mrs Anne-France Mattlet has been appointed as its director. She will be in charge of Europêche’s tuna strategy comprised of several pillars: tuna legislation and policy, governance, trade and market, scientific work and the promotion responsible image of EU purse-seine operations. More specifically, she will focus on initiatives such as the revision of the EU fisheries control system, the margin of tolerance and the autonomous tariff quotas for tuna loins.

With over 5 years of experience working on international ocean governance and tuna-related polices within the French administration, Mrs Mattlet has developed an in-depth understanding of fisheries policies decision-making process. She declared: “The EU purse-seine tuna fleet provides a vital source of food, employment, trade and economic welfare not only in Europe but also worldwide, including in developing countries. Operating across the oceans, our vessels comply with the highest standards of sustainability including working conditions, health, safety and hygiene. On top of that, our fleet has voluntarily adopted measures and invested in technology, at their own expense, to ensure optimal data collection. For instance, our vessels have 100% scientific observer coverage onboard and uses only non-entangling devices”.

Mrs Mattlet is worried that unworkable rules that do not take into account the technical and climatic specificities of tropical tuna fisheries in the EU control system, such as the margin of tolerance, are and would keep penalising the tuna sector. She concluded: “On the market side, we are convinced that the EU should only grant privileged access to non-EU tuna products if they do respect the same social and environmental standards than the EU ones. At present, low standard fish products unfairly compete with our own production in our own market. It is therefore paramount to address policy gaps and ensure an international level playing field, to protect our standards but also to ensure developing countries achieve the same ones, especially through the sustainable fisheries partnership agreements concluded with non-EU countries. We want a sustainable fishery as much as a thriving European tuna fishing sector”.

Javier Garat, President of Europêche, declared: “We are delighted to have Mrs Mattlet in Europêche’s team and warmly welcome her aboard. Her experience and expertise on tuna fisheries affairs will undoubtedly be a valuable asset to our companies in the international arena. I’m sure she will take a pro-active role in advocating fishing activities that are carried out in an environmentally friendly and socially responsible way”.

The EU fishing sector has presented to European authorities the critical measures that have to be taken in order to overcome the operational, commercial, and safety problems that the sector has only begun to endure and which will inevitably and without doubt worsen in the coming weeks due to the protective measures taken against the spread of the COVID-19. The primary concern of the sector is the continuity of fishing activities and food supply to EU citizens. Measures are also needed for those vessels forced to cease operations.

In a position paper sent to EU decision-makers the sector points out severe operational problems such as port and equipment supply restrictions, logistical difficulties, and soaring freight prices on shipments of fish. With regard to commercial factors, the sector shows concern over the collapse in first-sale fish prices, largely due to the closure of restaurants, schools, businesses and food markets and the strict limitations imposed on travel and tourism. Europêche reminds EU consumers that seafood is a vital part of a healthy diet and remains a safe, smart choice at grocery stores. Europêche underlines that the industry is increasingly limited in performing crew rotation or changes due to quarantines, get supply of drugs or protective materials or simply repatriate fishermen.

In order to alleviate as much as possible the current situation of trade and value chain disruptions and evaporating market demand resulting in falling price levels, Europêche asks for legislative changes to enable fishermen to carry over more than the existing 10% of their fishing quotas to next year and for fair intervention prices for unsold fish. In the document, the industry demands a series of measures that guarantee the logistical needs of crews and ships, such as the transport of crews, equipment, health protocols tailored to each fleet and guaranteeing the supply of masks and gloves both to ships and to fish markets or fish auction halls.

Europêche also urges policy-makers to modify the fisheries fund regulation in order to quickly adjust and provide financial aid for those fishing companies that are forced to cease their operations for imperative reasons such as member states measures to avoid the spread of the COVID-19, designation of high risk areas, crew infections or lack of market demand.

In addition to these vital mitigation measures the sector calls on Member States to introduce national measures such as VAT reduction, suspension of social security contributions and tax exemptions.

Furthermore, in view of the current developments, it only seems logical to extend the Brexit transition period with another 12 months at least, although Europêche understands that such decision depends on agreement by the UK.

Daniel Voces, managing director of Europêche, declared: “Our fishermen are doing a fantastic job. While far away from their homes and families, they continue bringing healthy seafood to our plates in a very challenging environment. They deserve the full attention of our public authorities to secure their safety, their economies and the continuity of the food supply”.
